Terms of Service

These terms govern your use of the Stampd service at stampd.shop, operated by Tideshift Ventures, LLC ("we", "us", "our"). By creating an account, you agree to these terms.

1. The Service

Stampd provides digital loyalty card management for small businesses. Merchants create stamp cards that their customers add to Apple Wallet or Google Wallet. Stampd handles pass generation, QR scanning, stamp tracking, and reward redemption.

2. Accounts

You must provide a valid email address to create an account
You are responsible for keeping your login credentials secure
One business per account; you may not share accounts
You must be at least 18 years old or the age of majority in your jurisdiction

3. Subscriptions & Payment

Stampd offers monthly (€5/month) and yearly (€50/year) subscription plans
New accounts start with a free trial period
Payments are processed by Stripe; you agree to Stripe's Terms of Service
Subscriptions renew automatically; you can cancel anytime via the billing portal
Refunds are handled on a case-by-case basis — contact support@stampd.shop

4. Right of Withdrawal (EU Consumers)

If you are a consumer in the EU/EEA, you have the right to withdraw from this contract within 14 days without giving any reason. To exercise your right of withdrawal, contact us at support@stampd.shop.

If you request that the service begins during the withdrawal period (e.g., by using the service after subscribing), you acknowledge that you will lose your right of withdrawal once the service has been fully provided.

5. Acceptable Use

You agree not to:

Use the service for unlawful purposes
Attempt to access other merchants' data or accounts
Abuse the QR scanning or stamp system (e.g., fraudulent stamps)
Upload malicious files or content
Reverse-engineer, scrape, or overload the service

6. Content & Branding

You retain ownership of your business name, logo, and brand assets
By uploading a logo, you grant Stampd a license to display it on loyalty passes and our service
You must have the right to use any content you upload

7. Apple Wallet & Google Wallet

Passes are delivered through Apple Wallet and Google Wallet. Use of these platforms is subject to their respective terms:

8. Service Availability

We aim for high uptime but do not guarantee uninterrupted service
We may perform maintenance with reasonable notice when possible
We reserve the right to modify or discontinue features with notice

9. Limitation of Liability

To the maximum extent permitted by law, Stampd is provided "as is" without warranties of any kind. We are not liable for indirect, incidental, or consequential damages arising from your use of the service, including but not limited to lost revenue or lost data.

10. Termination

You can delete your account at any time by contacting support@stampd.shop
We may suspend or terminate accounts that violate these terms
Upon termination, your data will be deleted in accordance with our Privacy Policy

11. Changes

We may update these terms from time to time. Continued use of the service after changes constitutes acceptance of the new terms.

12. Governing Law

These terms are governed by the laws of the State of Delaware, United States. If you are a consumer in the EU/EEA, you also retain the protection of mandatory provisions of the consumer protection laws of your country of residence.
